These Terms of Service (“Terms”) govern your access to and use of the website https://mindfulmoneycoaching.online (the “Service”) operated by The Synergy Group AG (“we”, “us”, or “our”). By accessing, browsing, or using the Service (including purchasing coaching services), you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms at any time. Changes will be posted here with the updated date. For material changes, we may notify you via email or on the Service. Your continued use after the effective date constitutes acceptance.

1. Eligibility and Age

You represent that you are at least 18 years old or the age of majority in your jurisdiction of residence, and have the legal capacity to enter into these Terms. If you are allowing minors to use the Service under your supervision, you confirm you have given consent and assume responsibility.

2. Use of the Service

The Service offers online coaching and related tools. You agree to use the Service only for lawful purposes and in compliance with these Terms and applicable laws (including Swiss law and laws in your jurisdiction). Prohibited uses include (but are not limited to):

  • Violating any laws, infringing intellectual property, or transmitting viruses/malicious code.
  • Harassing, abusing, or discriminating against others.
  • Collecting personal data without authorization.
  • Interfering with the Service’s security or operation.

We reserve the right to refuse service, terminate access, or remove content for any reason, including suspected violations.

3. Coaching Services and Refund Policy

Coaching services are personalized and delivered digitally (e.g., via modules, sessions, calls, materials, or group interactions). Descriptions are for guidance; actual scope may vary based on individual needs.

Refund Policy (voluntary; no statutory withdrawal right applies under Swiss law for these digital/personalized services):

  • Grounded to Prosper: Full refund available, provided that (1) cancellation is received in writing within 2 weeks from the date of order, AND (2) the client has not yet started Module 2. If Module 2 has been started, no refund will be provided.
  • Guided Group Coaching: Non-refundable. These are group sessions and are only initiated once a sufficient group has formed; no refunds are available once the program starts.
  • Money Mindset Shift & Money Mindset Signature: Pro-rata refund available (based on modules not yet accessed), provided that (1) cancellation is received in writing within 2 weeks from the date of order, AND (2) the client has not yet started Module 2. If Module 2 has been started, no refund will be provided.

To request a refund or cancellation, contact us at andre@thesynergygroup.ch with your order details. Refunds (where applicable) will be processed to the original payment method within a reasonable time after approval. We do not offer refunds outside these conditions.

We disclaim any guarantee of specific outcomes (e.g., financial, emotional, or professional results). Coaching is not financial, medical, legal, or therapeutic advice. Consult qualified professionals for such needs.

For users in the EU/EEA: Local consumer laws may provide additional rights (e.g., a 14-day withdrawal period for distance contracts). If applicable, contact us for clarification; Swiss law otherwise governs.

4. Accuracy of Information and Billing

We strive for accurate information but are not liable for errors, inaccuracies, or omissions. Prices and availability may change without notice. We reserve the right to refuse/cancel orders, limit quantities, or correct errors.

You must provide current, complete, and accurate account and payment information. Update promptly as needed.

5. Intellectual Property and User Content

All content on the Service (text, materials, designs) is our property or licensed to us. You may not reproduce, distribute, or exploit it without written permission.

If you submit feedback, testimonials, or content (“User Content”), you grant us a perpetual, royalty-free license to use, edit, publish, and distribute it. You warrant it does not infringe third-party rights and is not unlawful/offensive. We may monitor/remove objectionable content but have no obligation to do so.

6. Third-Party Links and Tools

The Service may link to or integrate third-party sites/tools (e.g., payment processors, WooCommerce). We provide them “as is” with no warranties or liability. Review their terms/privacy policies.

7. Personal Data

Your submission and use of personal information is governed by our Privacy Policy [link to your updated Privacy Policy] and Cookie Policy [link to your updated Cookie Policy], compliant with the Swiss Federal Act on Data Protection (FADP) and applicable laws.

8. Disclaimer of Warranties and Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind (express or implied), including merchantability, fitness for purpose, or non-infringement.

To the fullest extent permitted by law, we (including directors, officers, employees, affiliates) are not liable for any direct, indirect, incidental, consequential, special, or punitive damages (including lost profits/data) arising from your use of the Service, even if advised of the possibility. Liability is excluded for simple negligence but not for willful intent or gross negligence under Swiss law.

Some jurisdictions do not allow broad exclusions; in such cases, liability is limited to the maximum extent permitted.

9. Indemnification

You agree to indemnify and hold us harmless from claims, losses, or damages (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of laws, or infringement of third-party rights.

10. Termination

These Terms remain effective until terminated. We may terminate your access immediately for violations without notice. You remain liable for obligations incurred prior to termination.

11. Force Majeure

We are not liable for delays or failures due to events beyond reasonable control (e.g., natural disasters, strikes, pandemics, internet outages).

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland (excluding conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods). Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Zurich, Switzerland.

13. Miscellaneous

This version is tailored, compliant with Swiss law (voluntary refund policy, clear terms to avoid misleading consumers), and ready for your site. Replace placeholder links with actual ones. For maximum protection—especially with international users or if programs qualify as “Fernunterricht” in neighboring jurisdictions (e.g., Germany)—consider a quick review by a Swiss lawyer. Let me know if you’d like adjustments!
